The DIFC Courts are English-language, common-law courts operating inside the Dubai International Financial Centre. They run on their own procedural rules and case law, separate from the Arabic-language civil-law system used by onshore Dubai Courts. When do DIFC Courts have jurisdiction?
The Court of First Instance hears civil and commercial disputes connected to the DIFC, including:
- DIFC-connected disputes – contracts performed wholly or partly in the DIFC, transactions concluded there, or incidents that took place in the Centre.
- DIFC entities – claims involving the Centre’s bodies and DIFC-registered establishments.
- Opt-in jurisdiction – parties anywhere can agree in writing to DIFC Courts jurisdiction, either in the contract before any dispute arises or by agreement after the dispute has started.
Many disputes could plausibly go to either forum. Which court you end up in often turns on one clause in the contract — so have jurisdiction clauses reviewed before you sign, not after the dispute begins.

DIFC Small Claims Tribunal: limits that matter
- Claims up to AED 500,000 are heard by the SCT.
- Non-employment claims up to AED 1,000,000 can go to the SCT if all parties opt in writing — in the contract or after the dispute arises.
- Employment claims have no value cap for the SCT where the parties elect it in writing.
SCT procedure is simplified and quick compared to a full Court of First Instance claim, but limitation periods, evidence, and settlement positioning still decide outcomes — get advice before filing, not after a hearing date lands.

Can any Dubai lawyer represent me in the DIFC Courts?
No. Proceedings are issued by firms on Part I of the DIFC Courts' Register of Legal Practitioners, and courtroom advocacy needs individual rights of audience under Part II. Always ask who will actually issue and argue your case.
My contract has a DIFC Courts clause — what does that mean?
You have agreed to opt in to DIFC jurisdiction. Your dispute will run in English under common-law style procedure, and onshore Dubai Courts will generally not hear it. Strategy, costs, and evidence all need to be planned for that forum.
What is the Small Claims Tribunal and when can I use it?
The SCT is the DIFC Courts' fast track: claims up to AED 500,000, opt-in claims up to AED 1,000,000, and employment claims with no cap where both sides elect it in writing. Hearings are simpler and faster than a full trial.
What language and law apply in DIFC Courts?
